Employers could not ask about or use a job seeker’s past pay when hiring or setting pay. They must post a clear pay range, set honestly, in every job and promotion notice. Workers can refuse to share pay history and can ask for the range, without retaliation. If an applicant shares past pay on their own, it may be used only to raise an offer without causing illegal pay gaps. Violators could owe $1,000–$10,000 or more, plus fees. Workers can go to court alone or as a group within two years.
