This bill requires electric utilities to charge large non-residential customers—mainly data centers and similar facilities with peak demands of 100 megawatts or more—the full, incremental costs of any grid upgrades needed to serve them. These customers must provide financial assurances or upfront payments before upgrades begin and remain responsible for these costs even if they stop service. The requirements only apply when upgrades are necessary; if not, no special charges are imposed. It amends the Public Utility Regulatory Policies Act, directing state regulators to review and decide whether to adopt these rules within two years unless similar standards already exist.
